Welcome to EcoBay Fresh Market. These terms govern your use of our website, our Fresh Club rewards programme, and any purchases you make from us in store or online. By using our site or shopping with us, you agree to these terms.

1. About us

EcoBay Fresh Market is a local fresh food shop trading from 5/1063 Ferry Road, Ferrymead, Christchurch 8023, Aotearoa New Zealand. You can reach us at support@ecobayfresh.com. References to "EcoBay", "we", "us" or "our" mean EcoBay Fresh Market. "You" means the person using our website or shopping with us.

2. New Zealand consumer law

Nothing in these terms limits or excludes your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or other New Zealand consumer protection laws that apply when you buy goods or services from us as a consumer. Where you acquire goods or services for the purposes of a business, you agree that the Consumer Guarantees Act does not apply to the extent permitted by section 43 of that Act.

3. Prices, GST and product information

  • All prices are in New Zealand dollars and include GST unless stated otherwise.
  • We try hard to keep prices, stock levels and product details accurate, but errors do occur. If a price is clearly wrong, we may decline or cancel the sale and refund any payment.
  • Photos and descriptions are a guide only. Natural produce varies in size, shape and colour from week to week.
  • Weekly specials and fair everyday value pricing run while stocks last and may end without notice.

4. Click & Collect and orders placed through this site

  • Placing an order is an offer to buy. Your order is accepted when we confirm it by email or when you collect the goods, whichever happens first.
  • We may refuse, cancel or refund an order if an item is out of stock, mispriced, or if we suspect fraudulent activity.
  • Collection is from our Ferrymead store. Photo ID may be required. Uncollected orders may be cancelled after 72 hours and any payment refunded.
  • Restricted products (e.g. tobacco where stocked) will only be sold to customers aged 18 or over with valid ID.

5. Payment

In store we accept cash, EFTPOS and major credit cards. Online payments are handled by our payment provider; we don't store full card details on our servers. You confirm that any payment method you use is yours to use.

6. Freshness guarantee, refunds and replacements

If something isn't right, please email support@ecobayfresh.com or pop into the shop within 7 days of purchase with proof of purchase. We'll replace, refund or credit any product that isn't of acceptable quality, in line with our obligations under the Consumer Guarantees Act 1993. For fresh produce, please tell us as soon as possible — ideally within 48 hours — so we can put it right.

7. Fresh Club rewards

  • Fresh Club membership is free and available to NZ residents aged 16+.
  • Points, stamps and rewards have no cash value, can't be sold or transferred, and may expire as shown in the programme rules.
  • We may change, pause or end the programme, or update reward values, with reasonable notice. Where possible we'll honour rewards already earned.
  • Misuse of a member account (including sharing it, fraudulent scans, or returning items already redeemed for rewards) may result in the member being suspended and rewards forfeited.

8. Accounts and member logins

You're responsible for keeping your account details secure and for activity under your login. Please let us know straight away if you think your account has been used without your permission. Staff, manager and partner logins are for authorised users only.

9. Acceptable use of the website

You agree not to:

  • Use the site for any unlawful purpose or to breach anyone's rights.
  • Attempt to access areas of the site you're not authorised to use, probe for vulnerabilities, or interfere with how the site runs.
  • Scrape, copy or republish substantial parts of the site without our written permission.
  • Upload anything misleading, abusive, defamatory, or that infringes another person's intellectual property.

10. Intellectual property

The EcoBay name, logo, photography, written content and site design belong to EcoBay Fresh Market or our suppliers. You may view and share pages for personal, non-commercial use. Any other use needs our written consent.

11. Customer service chatbot and recipe content

Our website may include an AI-powered assistant to help answer questions about products, recipes and store info. Responses are generated automatically and may not always be accurate or complete. They're general information only and aren't a substitute for professional advice (including medical, dietary or allergy advice). Always read product labels and contact us if you have specific questions.

12. Allergens

We handle a wide range of products including those containing gluten, dairy, eggs, soy, nuts, seafood and sesame. While we take care, we can't guarantee any product or in-store prepared item is free from traces of allergens. If you have a serious allergy please check packaging and ask our team before purchasing.

13. Privacy

We collect and use personal information in accordance with the Privacy Act 2020. Full details of what we collect, why, and your rights are set out in our Privacy Policy. You can ask to access or correct your information at any time by emailing support@ecobayfresh.com.

14. Third-party links and services

Our website may link to or use third-party services (such as payments, email, maps or analytics). We aren't responsible for the content or practices of third-party sites, and your use of them is governed by their own terms.

15. Limitation of liability

Subject to your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 and other non-excludable New Zealand laws, to the maximum extent permitted by law our total liability to you for any claim arising out of your use of the site or purchase from us is limited to the amount you paid for the relevant product. We aren't liable for indirect or consequential loss (such as loss of profit or loss of opportunity).

16. Changes to these terms

We may update these terms from time to time. The current version will always be available on this page, with the "last updated" date at the top. Continued use of the site after a change means you accept the updated terms.

17. Governing law

These terms are governed by the laws of New Zealand. You and EcoBay submit to the non-exclusive jurisdiction of the New Zealand courts for any dispute arising out of or in connection with these terms.
