Gift voucher & store credit terms

These terms are written in plain English and are governed by New Zealand law. Nothing in them takes away rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or the Privacy Act 2020. If anything here conflicts with those laws, the law wins.

1. What these terms cover

They cover every voucher or credit EcoBay issues with a QR code and a six-character code:

The use-by date, the type and the amount are printed on the voucher itself and in the email. The printed date always wins over the defaults above.

2. Where and how to use it

  • Use it at EcoBay Fresh Market, 5/1063 Ferry Road, Ferrymead, at any checkout. A partner coffee voucher is used at the partner named on it, not at our till.
  • Show the QR code on your phone, the printed sheet, or read out the six-character code. Staff scan or type it and take the amount off your total.
  • It can be used on anything we sell, except where the law stops us (for example, a voucher can't be used to buy age-restricted products by someone under 18).
  • Vouchers and credits with a dollar value can be spent over several visits. Each time you use some, the till shows what's left and, if we have your email, we send you a short confirmation with the balance.
  • You can use more than one voucher or credit in the same shop. Earned Fresh Club rewards and partner coffee vouchers are used whole — one per shop.
  • We can't give change or cash for a voucher, and a voucher can't be used to buy another voucher.

3. Use-by dates

  • Every voucher shows a use-by date. It is valid for the whole of that day, New Zealand time.
  • After the use-by date any unused balance is lost. We won't send reminders unless you ask, so please note the date.
  • If you have a good reason for missing the date on a purchased voucher (illness, being overseas, a mistake on our side) email us within 3 months and we will usually reissue it. We can't promise this for free gifts from the store.
  • Store credit given as a remedy for goods that weren't right does not expire.

4. Anyone with the code can use it — keep it safe

  • The name printed on a voucher ("For Sam") tells you who it was sent to. It is not a security check: our till doesn't verify identity, so anyone who has the code can spend it.
  • Treat the code like a key, not like a note: don't forward the email or post a photo of it.
  • For larger vouchers our staff may ask for the name on the voucher. If it doesn't match, we may hold the voucher and contact the person it was sent to.

5. Lost, stolen or deleted vouchers

  • If you lose the email or sheet, or think someone else has your code, email club@ecobayfresh.com straight away with the code (if you have it) or the name and email the voucher was sent to.
  • If the voucher hasn't been used we cancel the old code and reissue the remaining balance to the same email address. The old code stops working immediately.
  • If it has already been used by the time you tell us, we can't replace it, but we will tell you when and where it was used and help you if the use looks fraudulent.

6. Refunds and the Consumer Guarantees Act

  • Anything you buy with a voucher or credit has the same Consumer Guarantees Act protection as anything you buy with cash.
  • If goods bought with a voucher aren't of acceptable quality, you get the remedy the Act gives you — repair, replacement or refund — and for a serious failure you choose.
  • A refund goes back to the way you paid: the voucher part goes back onto your voucher (and we extend its use-by date to at least 12 months from the refund), and any part you paid in money is refunded in money.
  • "Not redeemable for cash" means we don't swap a voucher for cash; it never limits your Consumer Guarantees Act rights.

7. Purchased gift vouchers — for the buyer

  • You'll get a till receipt showing the amount paid and the voucher code. Keep it — it's the proof that this voucher was paid for.
  • We can refund a purchased voucher to the buyer, to the original payment method, if it is unused and you ask within 14 days of purchase. After that, or once any of it is spent, it isn't refundable.
  • You can have it emailed to the recipient (we'll need their name and email — see section 10), printed, or both.

8. When we can cancel or adjust a voucher

We will only cancel or change a voucher or credit if:

  1. you or the person it was sent to ask us to reissue it (section 5);
  2. the buyer asks for a refund of an unused purchased voucher (section 7);
  3. we reasonably believe it was obtained or used fraudulently, or issued by mistake — in which case we email the address it was sent to, explain why, and give you 14 days to reply before anything is final; or
  4. we need to correct a clear arithmetic error in the balance — always with a note in the record you can ask to see.

We never shorten the use-by date or reduce the balance of a voucher already issued because we changed our programme or these terms. Fresh Club membership rules (including suspension for misuse) don't take away a purchased voucher or a remedy credit.

9. Records, disputes and fraud

  • Each code is random, works once per amount used, and is retired when reissued. Every use is recorded with the date, time, checkout, staff member, amount used and balance left; every issue records who issued it, why, and (for purchased vouchers) the receipt reference.
  • If you think a use wasn't you, reply to the confirmation email or contact us within 30 days; we'll check the record and CCTV where available.
  • Staff can undo a mistaken use within 15 minutes; managers can correct errors later. Any correction is logged and, if we've already emailed you a confirmation, we email you again.
  • We keep voucher and redemption records for 7 years to meet tax law, even after a member's account is closed (the record is then anonymised).

10. Privacy — recipients and givers

  • If someone sent you a gift: the giver gave us your name and email so we could deliver it. We use them only to send the voucher and a confirmation when it's used; we don't add you to any list and send no marketing. We delete them 90 days after the voucher is used, expires or is cancelled. You can ask to see, correct or delete them sooner by emailing club@ecobayfresh.com — deleting before the voucher is used means we cancel it and tell the giver.
  • If you're the giver: your name and any message you write are shown to the recipient, printed on the sheet if one is printed, and kept with the voucher record. We don't use them for anything else. Please don't include other people's details or anything you wouldn't want on a printed voucher.
  • Emails: voucher and used-confirmation emails are service messages, not marketing. Reply STOP to a gift email and we'll send nothing further about it, except a used-confirmation if it's spent. We honour that within 5 working days.

11. GST

All prices include GST at 15%. Where a voucher was paid for, GST is accounted for by EcoBay Fresh Market in line with the Goods and Services Tax Act 1985 rules for face-value vouchers; where it was given free, GST applies to what you actually pay at the till. This doesn't change what you pay — it's here so the treatment is clear.

12. Unclaimed money

An expired voucher is not money we owe you, so expired balances aren't "unclaimed money" under the Unclaimed Money Act 1971. If a purchased voucher ever reaches its use-by date unused, section 3 tells you how to ask for a reissue.

13. Changes to these terms

We may update these terms for vouchers issued after the change. Vouchers already issued keep the terms printed on them and this version, which we keep available at ecobayfresh.com/vouchers/v1.

If we can't sort it out, you can contact Consumer Protection (consumerprotection.govt.nz), the Commerce Commission (comcom.govt.nz), the Office of the Privacy Commissioner (privacy.org.nz) for privacy matters, or the Disputes Tribunal.
